Deepfakes

In 2024, Arizona enacted a law (AZ HB 2394) addressing both political and sexual deepfakes. The law gives political candidates a cause of action for digital impersonation absent a disclaimer. The measure also allows a person depicted in a sexual deepfake to sue for injunctive relief and damages.

In 2025, Arizona amended its child exploitation laws by enacting a law (AZ HB 2678) clarifying that unlawful visual depictions of minors include images created or modified by AI or digital editing tools. Additionally, in 2025, Arizona enacted a law (AZ SB 1295) making it a criminal violation to use a computer-generated voice recording, image, or video of another person with the intent to defraud other persons or with the intent to harass others.

Sexual Deepfakes

In 2025, Arizona enacted a law (AZ SB 1462) further addressing sexual deepfakes. The law clarifies that an image depicting a person in a state of nudity or sexual activity that did not occur is a realistic pictorial representation. Additionally, the law states that the depicted person need not have a reasonable expectation of privacy for the nonconsensual disclosure of such an image to be considered unlawful, unless the image was created or modified by the depicted person themselves.

Computing Power

In 2025, Arizona enacted a bill (AZ HB 2342) that prohibits a political subdivision from restricting an individual from lawfully accessing or using computational power in a residence. The bill defines computational power as “the use of computer hardware and software to process data, run algorithms, or perform tasks requiring significant computing resources, including artificial intelligence, blockchain, scientific research, and cloud computing.”
