AI Policy Overview

Florida lawmakers have enacted a handful of AI-related laws. Also in 2024, lawmakers enacted a law (FL SB 1680) creating the Florida Government Technology Modernization Council to study and monitor the development and deployment of AI systems, and also made it unlawful to possess or control computer-generated child pornography. That year, Florida lawmakers also enacted a law (FL HB 1361) providing for the award of grants to school districts to implement artificial intelligence in support of students and teachers. In 2025, Florida lawmakers continued their focus on deepfakes by enacting legislation requiring certain platforms to remove sexual deepfakes and making it unlawful to solicit computer-generated child pornography.

Deepfakes

In 2024, Florida enacted a political deepfake law (FL HB 919) that requires political advertising to include a disclaimer if it uses generative AI that appears to depict a real person performing an action that did not occur in reality and was created with the intent to injure a candidate or to deceive regarding a ballot issue. The law provides for civil and criminal penalties. 

In 2024, Florida enacted a sexual deepfake law (FL SB 1680), which makes it unlawful to possess or control computer-generated child pornography. In 2025, Florida built on this statute by enacting a law (FL HB 757/SB 1180), which makes it unlawful to solicit computer-generated child pornography. Florida also enacted another law in 2025 (FL HB 1161/SB 1400) requiring platforms to establish a take-down process to remove sexual deepfakes at the request of an individual.
