AI Policy Overview

Idaho lawmakers have not engaged with AI policy broadly but did enact several bills addressing deepfakes in 2024.

Deepfakes

In 2024, Idaho enacted a law (ID HB 575) to address deepfake media in the state. The law will make it unlawful to disclose explicit synthetic media without consent if the disclosure would cause the identifiable person substantial emotional distress or to harass, intimidate, or humiliate a person or obtain money through fraud. A week later, Idaho enacted another law aimed at sexual deepfakes (ID HB 465). This law adds to provisions relating to sexual abuse of children, prohibiting visual depictions including videos or images generated using generative AI or machine learning.

Also in 2024, Idaho enacted a law to limit the use of political deepfakes. The law (ID HB 664) provides injunctive relief and damages for a candidate whose action or speech is deceptively represented through the use of synthetic media in an electioneering communication.
