AI Policy Overview

Indiana lawmakers have engaged with AI policy regarding deepfakes and government use. Lawmakers signaled an interest in AI in 2023 when legislative leadership directed the Interim Commerce and Economic Development Interim Study Committee to study the risks and challenges of AI, as well as how AI may benefit existing industries. 

In 2024, lawmakers enacted two bills into law addressing political deepfakes and sexual deepfakes. Another law enacted in 2024 (IN SB 150) creates an AI task force to study and assess the use of AI technology by state agencies and requires an inventory of all AI use by the state.

Deepfakes

In 2024, Indiana enacted two laws addressing the proliferation of deepfake media for political campaigns and nonconsensual sexual images. The sexual deepfake law (IN HB 1047) defines certain images created by AI to constitute an "intimate image" for purposes of the crime of distributing an intimate image. And the political deepfake law (IN HB 1133) prohibits the use of deepfakes in political advertising without a disclaimer and provides a civil action for the person being depicted.
