AI Policy Overview

Maryland lawmakers began considering issues surrounding AI in 2023 in a hearing by the  Joint Committee on Cybersecurity, Information Technology and Biotechnology. The committee also discussed AI in a November 2023 meeting. 

Under a 2024 law (MD SB 818) state agencies are required to conduct certain inventories and assessments on AI systems. The law also requires higher education institutions to establish policies on AI and prohibits procurement of an AI system that does not adhere to certain policies. Finally, the law established a Governor's Artificial Intelligence Subcabinet.

In 2025, lawmakers took steps to regulate some uses of AI by enacting legislation addressing how AI is used in healthcare (MD HB 820) and establishing a civil action for victims of revenge porn created using AI (MD SB 360).

Employment

In 2020, Maryland enacted a law (MD HB 1202) prohibiting an employer from using certain facial recognition services during an applicant's interview for employment unless the applicant consents. Notably, the law does not contain an explicit cause of action to enforce violations.

Healthcare

In 2025, Maryland enacted a law (MD HB 820) requiring insurance carriers, pharmacy benefit managers, and private review agents to report to the Maryland Insurance Commissioner the number of adverse decisions issued and whether AI, an algorithm, or another software tool was involved in making the adverse decision.

Deepfakes

In 2025, Maryland enacted a law (MD SB 360) creating a civil action for victims of revenge porn featuring an identifiable person, including digitally created images.

Facial Recognition

In 2024, Maryland enacted a law (MD SB 182), which establishes requirements, procedures, and prohibitions relating to the use of facial recognition technology by a law enforcement agency. The law also preempts some local regulations on facial recognition.

  • 2025 - Maryland enacted MD HB 956, which creates the Workgroup on Artificial Intelligence Implementation to monitor and make recommendations for future AI regulation. 

  • 2025 - Maryland enacted MD SB 360, which creates a civil action for revenge porn depicting an identifiable person. 

  • 2025 - Maryland enacted MD HB 820, which requires health insurers to report the number of adverse decisions issued and whether AI was used in making the decision. 

  • 2025 - Maryland enacted MD SB 294/HB 376, which amends the membership of the Maryland Cybersecurity Council and requires the council to address the cybersecurity risks of AI and quantum computing.

  • 2024 - Mayland enacted MD SB 182, which regulates the use of facial recognition technology by law enforcement and provides for pre-emption of local law.

  • 2024 - Mayland enacted MD SB 182, which requires reviews and policies of AI use by state agencies and higher education institutions.
