AI Policy Overview
New Jersey lawmakers have yet to prioritize artificial intelligence policies broadly. However, Governor Phil Murphy (D) signed an executive order on Oct. 10, 2023, establishing an advisory Artificial Intelligence Task Force to study the impact of AI on society. The order also calls on state agencies to develop guidelines for the ethical use of AI to improve government efficiency.
In 2024, New Jersey enacted a law (NJ SB 3432) establishing the “Next New Jersey Program” to attract new investment to the state in the artificial intelligence industry through tax credits. Businesses with agreements with the New Jersey Economic Development Authority will be eligible for a tax credit equaling the lesser of the product of 0.1% of the eligible business’s total capital investment multiplied by the number of new full-time jobs; 25% of the eligible business’s total capital investment; or $250 million.
