AI Policy Overview

The New Mexico House Science, Technology & Telecommunications Committee held a meeting in July 2023 that covered the impact of AI on civil liberties, criminal justice, and its use in spreading misinformation. The Committee met again in November 2023 to discuss transparency in AI. In 2024, lawmakers enacted a political deepfake bill into law.

In 2025, New Mexico lawmakers enacted a law (NM HB 20) establishing the Economic Development Department as an executive branch agency. This law also creates a Technology and Innovation Division within the Department, and tasked it with developing and maintaining a strategic plan targeting specific sectors, including advanced computing, which includes AI, quantum computing, cybersecurity, and other areas of strategic importance for economic development.

Deepfakes

In 2024, New Mexico enacted a law (NM HB 182) to require a political advertisement generated in whole or in part by using artificial intelligence to include a disclaimer. The law makes it a violation of the Campaign Reporting Act if the distribution occurs within 90 days of an election.

Healthcare

In 2025, New Mexico enacted a law (NM HB 178) directing the state board of nursing to establish standards for the use of AI in nursing.

  • 2025 - New Mexico enacted NM HB 20, which creates the Technology and Innovation Division within the Economic Development Department to develop a statewide technology and innovation strategic plan that includes provisions for AI. 

  • 2025 - New Mexico enacted NM HB 178, which directs the board of nursing to establish standards for the use of AI in nursing.

  • 2024 - New Mexico enacted NM HB 182, which requires a political advertisement generated in whole or in part by using AI to include a disclaimer and prohibits distribution within 90 days of an election.
