AI Policy Overview
North Dakota lawmakers have yet to prioritize artificial intelligence policies broadly. However, lawmakers have signaled an interest in learning more about AI, and in August 2023 the Information Technology Committee held a briefing on the use of AI in state government agencies, future plans for the use of AI technologies, and the effect on cybersecurity. In 2025, lawmakers enacted several laws addressing deepfakes, but did not address AI more generally.
Deepfakes
In 2025, North Dakota lawmakers enacted several laws addressing deepfakes. Three of these laws addressed sexual deepfakes: (1) ND HB 1351 amended existing law to add computer-generated content to prohibiting sending nonconsensual sexually explicit images and established a civil action if an identifiable person was harmed by sharing such imagines; (2) ND HB 1386 amended existing laws on child pornography to include computer-generated images; and (3) ND HB 1410 which directs an interim study of state laws on child abuse and neglect, including using AI in creating child sexual abuse material.
In 2025, North Dakota lawmakers also enacted a law (ND HB 1167) which requires political advertisements made with AI, in whole or in part, to include a disclaimer.
